Persetujuan ini mulai berlaku pada tanggal diterimanya pemberitahuan terakhir dimana Para Pihak pada Persetujuan saling memberitahukan melalui saluran diplomatik bahwa persyaratan konstitusional untuk berlakunya Persetujuan ini telah dipenuhi. Persetujuan ini berlaku untuk jangka waktu lima tahun dan akan secara otomatis diperpanjang untuk jangka waktu setiap satu tahun kecuali salah satu Pihak pada Persetujuan mengakhiri dengan memberitahukan secara tertulis sedikitnya enam bulan sebelum masa Persetujuan ini berakhir. Salah satu Pihak pada Persetujuan dapat meminta, secara tertulis, perbaikan atau perubahan terhadap seluruh atau sebagian dari Persetujuan ini. Setiap perbaikan atau perubahan dimana telah disetujui oleh para Pihak pada Persetujuan mulai berlaku sejak tanggal sesuai penetapan dari Para Pihak pada Persetujuan. Pengakhiran Persetujuan ini tidak mempengaruhi terhadap keabsahan dan jangka waktu dari setiap pengaturan, kontrak dan kegiatan yang dilakukan di bawah Persetujuan ini sampai pengaturan-pengaturan, kontrak-kontrak atau kegiatan-kegiatan tersebut telah diselesaikan. Sebagai bukti, yang bertanda tangan di bawah ini yang diberi kuasa penuh oleh Pemerintah masing-masing telah menandatangani Persetujuan ini. Dibuat di Jakarta pada tanggal 20 Februari 1998 dalam rangkap dua dalam bahasa INDONESIA, Inggris dan Arab, semua naskah mempunyai kekuatan hukum yang sama. Apabila terdapat perbedaan penafsiran atas Persetujuan ini, maka naskah bahasa Inggris yang berlaku. Untuk Pemerintah Untuk Pemerintah Republik Yaman ttd. ttd. Ali Alatas Abdul-Kareem Al-Eryani Menteri Luar Negeri Wakil Perdana Menteri Menteri Luar Negeri TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF YEMEN The Government of the Republic of INDONESIA and the Government of the Republic of Yemen, hereinafter referred to as the Contracting Parties. Desirous of enhancing and promoting trade relations between their respective countries on the basis of mutual benefits; Have agreed on the following : Article 1 The Contracting Parties shall work towards the expansion and the development of a range of commercial exchange or trade relations between their respective countries in accordance with the provisions stated in this Agreement and the laws and regulations in force in their respective countries. Article 2 Each Contracting Party shall accord to the other Party the Most Favoured Nation Treatment in matters relating to custom duties and rules and procedures pertaining to imports and exports. Theses provisions shall not be applicable to privileges and concessions which either Party has granted or may grant to : a. neighbouring countries in order to facilitate frontier trade b. countries who are members of a free trade zone or customs union that either Party has joined or may enter into c. countries who are engaged with either Party by trade preferences d. goods imported under or by virtue of relief programmes. Article 3 Exports and imports of goods and services between the Contracting Parties shall be carried out in accordance with the laws and regulations in force in each country, international trade practices based on contracts to be concluded between the natural and juridical persons of both countries. Article 4 All payments arising under this Agreement shall be made in freely convertible international currencies in accordance with the laws and regulations in either country unless otherwise specifically agreed upon between the Contracting Parties. Article 5 The Contracting Parties shall encourage and facilitate the continuation of development and diversification of trade exchange and economic cooperation between the two countries in accordance with the laws and regulations in force in their respective countries. Article 6 The Contracting Parties shall encourage the exchange of expertise, visits, and training between the two concerned Ministries and their related organizations. Article 7 The Contracting Parties shall encourage each other to participate in exhibitions and international fairs which would be held in their respective countries. Article 8 The following items by the other Party shall be exampted from custom duties when entering the territory of either Party, in accordance with the customs laws and regulations in force in the two countries: a. samples, catalogues of goods, price-lists, and other materials of non-commercial value pertaining to advertising. b. exhibits, materials and tools designated for erection and prepartion of exhibition halls. c. products specified in (a) and (b) are not to be sold unless a prior permit is granted and only after the payment of their dues and custom duties. Article 9 The provision of this Agreement shall not apply on products and materials banned from entering or exchange or usage in either country for reason of religion, health, security, environment, culture, or protection of plants and animals against disease and pests in accordance with the laws and regulations force in the two countries. Article 10 Agricultural, plants, animal, and food products exported from either Party to the other Party shall comply with agricultural and health requirements in force in the importing country, and shall be accompanied by a health certificate issued by the concerned authority in the exporting country. Article 11 This Contracting Parties shall provide each other intellectual property protection in accordance with the Agreement on Trade-Related Aspects of Intellectual Property Rights which forms an integral part of the Final Act Embodying the Results of the Uruguay Round of Multilateral Trade Negotiation signed in Marrakesh on 15 April 1994. Article 12 Any dispute between the Contracting Parties on the interpretation or implementation of this Agreement shall be settled amicably by both Contracting Parties through diplomatic channels. Article 13 This Agreement shall enter into force on the date of receipt the last notification by which the Parties inform each other, through diplomatic channels, that their constitutional requirements for giving effect to this Agreement have been fulfilled. This Agreement shall remain in force for a period of five years and shall automatically be extended for subsequent periods of one year each unless either Party terminates it by giving written notification at least six months prior to its expiration. Either Party may request in writing revision or amendment of all or parts of this Agreement. Any revision or amendment which has been agreed to by Parties shall come into effect on such date as will be determined by the Parties. Termination of this Agreement shall not affect the validity and duration of any arrangements, contracts and activities made under this Agreement until the completion of such arrangements, contracts or activities. IN WITNESS WHEREOF, the undersigned, duly authorized thereto by their respective Governments, have signed this Agreement. DONE at Jakarta on this 20th day of February 1998 in duplicate in Arabic, INDONESIA and English languages, all texts being equally authentic.
