Persetujuan ini mulai berlaku pada tanggal penerimaan pemberitahuan terakhir oleh masing-masing Pihak, melalui saluran diplomatik, bahwa persyaratan perundangan-undangan untuk memberlakukan Persetujuan ini telah dipenuhi.
Persetujuan ini berlaku untuk jangka waktu 5 (lma) tahun dan akan secara otomatis diperpanjang untuk jangka waktu 1 (satu) tahun berikutnya kecuali jika salah satu Pihak memberitahukan secara tertulis mengenai keinginan untuk mengakhiri Persetujuan ini paling sedikit 6 (enam) bulan sebelum berakhirnya Persetujuan ini.
Berakhirnya Persetujuan ini tidak mempengaruhi keabsahan atau berlakunya setiap pengatur, kontrak dan kegiatan-kegiatan yang masih berjalan dalam kerangka
Persetujuan ini.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, dengan diberi kuasa oleh Pemerintah masing-masing, telah menandatangani Persetujuan ini.
DIBUAT di Jakarta pada tanggal 8 Maret 1996 dalam rangkap asli dalam bahasa INDONESIA dan Inggris, semua naskah mempunyai kekuatan hukum hukum yang sama.
Apabila terdapat perbedaan dalam penafsiran dalam Perjanjian ini, naskah dalam bahasa Inggris yang akan berlaku.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE ISLAMIC REPUBLIC OF PAKISTAN ON ECONOMIC AND TECHNICAL COOPERATION ============================================================ The Government of the Republic of INDONESIA and the Government of the Islamic Republic of Pakistan, hereinafter to as "the Contracting Parties";
DESIROUS of expanding and enhancing bilateral relations and cooperation on a lasting and long term basis;
CONVINCED of the necessity of lasting and effective cooperation in the interests of both countries; and
CONFIRMING their interests in the strengthening of bilateral cooperation between the two countries; and
GUIDED by the the desire to strengthen the existing friendly relations and to promote the expansion of economic and technical cooperation between the two countries based on the priciples of equality, mutual benefit and full respect of sovereignty;
HAVE AGREED as follows
ARTICLE I
The Contracting Parties shall endeavour to take all necessary measures to encourage and to develop economic and technical cooperation between the two countries within the framework of the present Agreement and in conformity with their respective laws and regulations.
ARTICLE II
The economic and technical cooperation referred to the present Agreement may be developed in the areas which be specified be by mutual agreement.
It will consist particularly in developing the commercial exchanges between the two countries and encoouraging the direct investments and the estalishment of permanent business relations and partnership between the companies of the two countries.
ARTICLE III
The economic and technical cooperatarion shall be conducted in accordance with the capabilities and requirements of the respective Contrating Parties as well as with the terms and conditions to be agreed upon between the Contracting Parties. The detailed provisions telating to the forms and metheds as well as to the condhtions of such cooperation in the agreed areas shall be laid down in separate implemeneting arrangements.
ARTICLE IV
1. The Parties shall take all necessary measures to encourage technical cooperation between them through the exchange of seientific and technological data and of experts, technicians and trainers in addition to the encouragement of all aspects of technical cooperation between the specialized institutions of both Parties.
2. The Parties agree that any intellectual property arising under the implementation of this agreement will be jointly owned and that
a. earh Party shall be allowed to use such intellectual property for the purposes of maintaining adapting and improving the relevant property;
b. in the event that the intellectual property is used by commercial purposes by the Party and/or institutions on behalf of the Party for commercial purposes the other Party shall entitle to obtain equitable portion of the royalty
3. The Parties shall indemmty each other that that the intellectual property rights brought by the Party into the territory of the other Party for the implementation of any project arrangement or activities is not resulted from any intringement of third party's legitimate rights
4. The Parties shall waive each other from any claim made by third party on the ownership and legality of the use of intellectual property rights which is brought in by the Party for the implementation of any project arrangement or activities.
ARTICLE V
The Contracting Parties agree to establish a Joint Commission to exemine the implementation of this Agreement to discuss the issues that might arise from the application of this Agreement and to make all the necessary recommendation for the achievement of its goals.
This Joint Commission shall meet when considered appropriate by mutual agreement, afternately in INDONESIA and Pakistan This Joint Commission shall whenever necessary establish working groups and appoint experts and advisors to attend the meetings It will constitute, furthermore, a framework for exchange of view points, concertation and coordination of positions in the international fora and institutions where the developing countries are involved
ARTICLE VI
Any disputes between the Contracting Parties concerning the interpretation or implementation of the present Agreement shall be settled amreably through consultations or negotiations
ARTICLE VII
At the request of either Contracting Party, the present Agreement may be amended or revised by mutual censent
ARTICLE VIII
By entering force this Agreement, the Agreement relating to Technical Cooperation between the Republic of INDONESIA and the Islame Republic of Pakistan, signed August 9, 1965 shall be terminated.
ARTICLE IX
This Agreement shall enter into force on the date of the recept of the last notification by which the Parties inform each other, through diplomatic channels, that their respective constitutional requirements for for giving effect to this Agreement have been fulelled The present Agreement shall remain in force for the period of 5 (five) years and shall automatically be extended for subsequsent periods of 1 (one) year unless either Contracting Party terminates it by giving written notification at least 6 (six) months prior to its expiration.
The termination the present Agreement shall not affect the validity and duration of any arrangement, contract and activities made under the present Agreement.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.
DONE at Jakarta on this Maret 8th 1996, in duplicate in Indonesian and English languages, all texts being equally authentic. In case of divergence of interpretation of this Agreement, the English text shall prevail.
